Cruisetopic is a trademark used by TravelServices Shpk (hereinafter Cruisetopic) which operates and acts as an intermediary between the Client and the Cruise Line or Tour Operator and Travel Agency (Travel Agency includes online travel agencies, hotels, airlines and travel insurance providers). For this reason, the General Conditions applied to the cruise you have booked may vary depending on the specific Cruise Line. In the execution of this activity Cruisetopic makes use of a technical partner for booking and collection using the agency license "CruiseTopic di Digitaltrend Italia S.r.l.". SCIA REP_PROV_MI/MI-SUPRO/0272239 DEL 20/12/2019 Insured RC with Europ Assistance policy n° 4140760 of 21/03/19 and ordinary member of Fondo vacanze Felici iscr. n°1735 of 16/4/2019. In the event that Cruisetopic operates as a Tour Operator (for example in the booking of packages for/post cruise) the general conditions of sale of tourist packages approved by FIAVET will be applied.

Conditions of use of the site

Access to this website implies, on the part of the user, the unreserved acceptance of the terms and conditions set out below without exception. Failure to accept any of these Terms and Conditions will result in your prohibition from using the Internet Site. The Website is the property of Cruisetopic. The logos relating to each product and/or company mentioned on the Cruisetopic website are the exclusive property of their authors and depositors. Access to the Cruisetopic site is exclusively reserved for the personal use of users waiting to obtain cruise-related information. The information provided on this site may be transmitted, reproduced or printed for personal use only. It is formally forbidden to modify, reproduce, copy or exploit the Cruisetopic site from a commercial point of view. Any use of one or more parts of the site must be subject to written authorization by the owner.

All descriptions and information provided on the site are not to be considered definitive, the photographs displayed do not constitute a contractual element and are purely decorative, can not therefore engage our responsibility. To verify in detail the characteristics of the cabin you have booked, we invite you to consult directly the website of the shipping company. Cruisetopic does not guarantee the accuracy of the information provided by the shipping companies, is not responsible for changes that may occur with respect to photographs, prices, taxes, terms and conditions. The presence of special offers on the site does not guarantee their availability or use, which is the sole responsibility of the shipping company. Cruisetopic may, at its sole discretion, without notice and for any reason, change the information contained on the site. Your use of the site following the changes constitutes your acceptance of any changes superseding the previous terms and conditions.

Any such changes will not affect your obligations and rights arising prior to such changes. Your use of or access to the Site following the modifications will be subject to the terms and conditions then in effect. Despite our vigilance, errors and/or omissions may be present within the site but can in no way be attributed to us. Cruisetopic and all those who are mentioned on this site, disclaim any responsibility for damages, whatever their nature, which may result from the use of the data on our site; the user is therefore entirely responsible for the use he/she makes of this information. 

Modalities of purchase and withdrawal

1) Confirmation of the Cruise

For each proposed cruise the acceptance of the offer is subject to: 

For the buyer from the confirmation carried out through the acceptance of the general conditions of sale affixed on the on line contract and to the sending of the balance or deposit reported on the travel contract and correctly inserted all the necessary data of all the passengers.

On the part of the seller is subject to sending e-mail confirmation of booking. The prices of all individual items in the quote/contract will be subject to reconfirmation until Cruisetopic sends the booking confirmation. 

The published prices are updated directly from the Database of the shipping companies, by means of xml integrations, and refer to the price for two paying adults in a double cabin. If the payment is made by bank transfer or postal bulletin, it is necessary to send the payment receipt by email.

Due to updating problems or the continuous updating of the rates, the published prices must necessarily be reconfirmed by one of our operators. To complete the booking you must sign the travel contract and make the payment of the deposit or the balance where applicable. Generally, bookings will be confirmed through the payment of a deposit of 35% at the time of booking and a balance of 65% within 35 days before the date of departure of the cruise. This general custom can vary depending on the individual cruise lines and depending on the rates applied to the reservation. In any case, at any time this custom may be subject to change at the sole discretion of Cruisetopic.

Cruisetopic is in no way responsible for the assignment of cabins. The cabin is assigned by the owner's office, Cruisetopic has no power to modify or intervene in the assignment process. The cabin number taken in the option phase cannot be guaranteed as the shipowner has the right to change it at any time. For multiple guaranteed cabins it is possible that the owner assigns more than one double cabin.

The prices published on the Medium and Long Range offers generally refer only to the cabin price, excluding flights, taxes and insurance. The fruition of the same could be bound to the purchase of the charter flight made available by the shipowner. It is mandatory for the buyer to verify before the departure to be in possession of the identity document (as well as visas eventually necessary including the issuance of ESTA admission for the United States of America that can be requested on the site https://esta.cbp.dhs.gov/) required for the chosen cruise and to check its expiration. In case a guest is not in possession of the required document, he/she will not be able to embark and will not be entitled to any refund. Cruisetopic and its partners will be held harmless from any failure on the part of the client to check identity documents, visas or any other type of document required to pass customs and border controls.

Prices may sometimes include a service fee for the advice provided in the choice of the best travel solution by Travelservices sh.p.k. which is the owner of the Cruisetopic group. This service is provided directly by Travelservices sh.p.k. The payment will be made together with the cost of purchased tourist services for the convenience of the buyer. The buyer will still have the possibility to request a receipt of payment directly from Travelservices sh.p.k.

As far as insurance coverage is concerned, Cruisetopic, proposes to all clients the Cruise happy card that includes the following services:

1.     Cancellation-medical-baggage insurance

2.     Dedicated assistance with direct customer service

3.     WUP direct after-sales phone number

4.     Preview of special conditions and promotions by the cruise lines

This card is never refundable in case of cancellation.

2) Payment for the Cruise

The following forms of payment are accepted

o Bank Transfer

o Credit Card

o Postal Bulletin

If the payment is made by bank transfer or postal bulletin it is necessary to send the receipt of payment by email.

If the payment is made by credit card after confirming the booking request by entering all the required data in the appropriate page of the site will receive an e-mail with a booking number. Subsequently, we will check your reservation and that the payment can be processed correctly. Our obligation to confirm the cruise will be subject to the regular payment of the actual availability/cost of the chosen cabin. In the event that a credit card with insufficient funds is used and/or a credit card that is rejected by the bank due to other reasons attributable to the cardholder, Cruisetopic will provide you with instructions to finalize payment of your reservation (until full payment is effective, you will not be able to receive confirmation of your requested reservation and the company's rate).

If the reservation is paid for with a credit card belonging to a third party, we reserve the right to request written authorization from the cardholder as well as a photocopy of his or her ID and a photocopy of the credit card. All e-mail addresses used must be valid at the time of booking.
In an effort to minimize the effects of credit card fraud, Cruisetopic reserves the right to conduct spot checks, and to ask for proof of your address and/or a copy of your credit card before issuing a confirmation  booking confirmation.

In order to provide additional security, you will be asked to enter all information found on your card for each purchase made through the Cruisetopic site. You authorize Cruisetopic to use the credit card information provided by you, even after the booking request has been made:
1.In order to make the payment of the requested services and agency fees,
2. for the payment of the premium of the eventual insurance,
3. for the processing of any refunds,
4. for the payment of agency fees due for services requested post-brokerage,
5. for the payment of the balance of the cruise booked in the case where there is a deposit and a balance after the date of booking.
6. payment of monthly installments for the balance of the cruise

3) Cancellation or modification of the cruise

The possibility of cancelling or modifying a booked product or service, and the relevant terms and conditions, will depend exclusively on the specific terms and conditions indicated in the following tables. Some special and promotional fares have different terms and conditions from the general ones. Therefore, it may not be possible to cancel or modify certain products or services without penalty. In the event of cancellation or modification of a reservation, Cruisetopic will charge €100,00 per passenger as "administrative handling fee" in addition to the penalties.

When booking flights through Cruisetopic, an issuing commission of 20,00 € per ticket will be requested and the sales conditions dictated by each airline will be applied according to the type of ticket. Before concluding the booking of your cruise, you can check the General Conditions on our websites.

The buyer agrees to read these documents and declares, by accepting the purchase contract, to have read the full terms and conditions of sale and to accept them.

There is no right of withdrawal. The right of withdrawal is exercised pursuant to and for the purposes of art. 64 et seq. of Legislative Decree 206/05 and art. 36 et seq. of Law 9902/2008 (Consumer Code). Beyond its generic and consolidated civil law nature, the Consumer Code has recognized the consumer, for contracts concluded at a distance and off-premises, the right to withdraw unilaterally from the contract entered into for the purchase of goods and services. However, the right of withdrawal can not be exercised by the consumer, inter alia, to services relating to accommodation, transport, catering, leisure, when there is a date or a specified period for the supply (eg by reservation), provided that such provisions are written on the contract and, therefore, the consumer is aware of it. A fortiori is not provided for the right of withdrawal, by the consumer, according to the coordinated provision of Article 55 paragraph 1, letter b) and the following paragraph 2 letter a) and art. 37/8/h of the Consumer Code.

All cancellations or changes to the quotes booked with the use of a Voucher following the Decree of 25-03-2020 regarding Covid19, will be subject to a 100% Penalty Fee (the validity of the Voucher is 24 months from the date of issue).
In the event of modification or cancellation of previously modified bookings, the applicable cancellation and modification conditions are 100%.

GENERAL CONDITIONS OF CANCELLATION

In case of cancellation 10% of the total amount of the trip will be charged for administration costs with a minimum of € 100,00 per passenger in addition to the cost of the Happy Cruise Card.
Cancellation penalties 
-more than 120 days from the date of departure: 10% of the total cost of the trip; (with a minimum of 100€ per passenger)
-from 120 to 91 days from the date of departure: 25% of the total cost of the trip
-from 90 to 61 days before departure: 50% of the total cost of the trip
-from 60 to 31 days from the date of departure: 75% of the total cost of the trip
-less than 30 days or no-show at embarkation: 100% of the total cost of the trip
Special conditions of cancellation for cruises of duration equal to or greater than 15 days: up to 61 days prior to departure as in the indicative table above, less than 61 days from the date of departure penalties increase to 100% of the total cost of the trip. 

In case of cancellation of a booking with Msc Cruises, Cruisetopic will still retain the registration fees. This amount, not refundable, will be added to the penalties applied.
Any request for changes (passenger names, travel documents, cabin occupants, etc.) will result in a handling fee of € 100.00.
In any case, reference will be made to the special conditions of the individual companies listed below in the event that they are worse than the general conditions of cancellation

SPECIAL CONDITIONS OF CANCELLATION FOR PROMOTIONAL RATES

COSTA CRUISES
- from confirmation to 91 days before the date of departure: 25 % of the total cost of the trip
- from 90 to 61 days before the date of departure: 50% of the total cost of the trip
- from 60 to 51 days before the date of departure: 75 % of the total cost of the trip
- from 50 days before date of departure or failure to board: 100 % of total cost of trip
Any request for changes (passenger names, travel documents, cabin occupants, etc.) will result in a handling fee of € 100.00.

AZAMARA CONDITIONS
- more than 120 days from the date of departure: 25% of the total cost of the trip;(with a minimum of 90€ per passenger)
- from 120 to 91 days from the date of departure: 40% of the total cost of the trip
- from 90 to 61 days from the date of departure: 60% of the total cost of the trip
- less than 60 days or no-show at embarkation: 100% of the total cost of the trip

CUNARD CONDITIONS
- more than 120 days from the date of departure: 25% of the total cost of the trip
- from 120 to 31 days before departure date: 50% of total cost of trip
- less than 30 days or no show at embarkation: 100% of total cost of trip

HOLLAND CONDITIONS
- more than 120 days from the date of departure: 25% of the total cost of the trip
- from 120 to 31 days before departure date: 75% of total cost of trip
- less than 30 days or no show at embarkation: 100% of the total cost of the trip

 NORWEGIAN CRUISE LINE CONDITIONS
- more than 120 days from the date of departure: 30% of the total cost of the cruise per passenger
- from 120 to 91 days from the departure date: 75% of the total cruise cost per passenger
- less than 90 days from the departure date: 100% of the total cruise cost

 OCEANIA CRUISES CONDITIONS
- from confirmation to 151 days before the departure date: 25% of the total cost of the cruise
- from 150 to 121 days from the date of departure: 50% of the total cost of the trip
- from 120 to 91 days before the departure date: 75% of the total cost of the trip
- less than 90 days before departure date: 100% of the total cost of the trip

PONANT CONDITIONS
-More than 215 days from the date of departure: 25% of the total cost of the trip
- 214 to 125 days from the date of departure: 50% of the total cost of the trip
- 124 to 95 days from the date of departure: 75% of the total cost of the trip
- less than 94 days or failure to show up for embarkation: 100% of the total cost of the trip

PAUL GAUGUIN CONDITIONS
- More than 215 days before departure: 25% of the total cost of the trip
- 214 to 125 days from the date of departure: 50% of the total cost of the trip
- 124 to 95 days from the date of departure: 75% of the total cost of the trip
- less than 94 days or failure to show up for embarkation: 100% of the total cost of the trip

 REGENT CONDITIONS

Cruises of 14 nights or less:
- Up to 151 days prior to departure: 25% of the total cost of the trip
- from 150 to 91 days before departure: 30% of the total cost of the trip
- 91 to 76 days prior to departure: 60% of total trip amount
- Less than 76 days before departure: 100% of the total cost of the trip   

      Cruises of 15 nights or more:
- Up to 151 days prior to departure: 25% of total trip amount
- From 150 to 121 days before departure: 50% of the total cost of the trip
- 91 to 120 days prior to departure: 75% of total trip value
- Less than 90 days before departure: 100% of the total cost of the trip

 REGENT CONDITIONS - WORLD TOUR
- more than 151 days before departure: 25% of the total cost of the trip
- from 150 to 121 days before departure date: 50% of the total cost of the trip
- 120 to 91 days from the date of departure: 75% of the total cost of the trip
- less than 90 days or no-show at embarkation: 100% of the total cost of the trip

 SILVERSEA CONDITIONS
- more than 120 days from the date of departure: 25% of the total cost of the trip
- from 120 to 91 days from the date of departure: 75% of the total cost of the trip
- less than 90 days or no show at embarkation: 100% of total cost of trip 

  PRINCESS CRUISES CONDITIONS
- more than 120 days from the date of departure: 40% of the total cost of the trip
- 120 to 91 days from date of departure: 75% of total cost of travel
- less than 90 days or failure to show up for embarkation: 100% of the total cost of the trip

CARNIVAL CONDITIONS 
Cancellation penalties are 100% from the time of booking confirmation. Any change to the contract (passenger substitution, cabin occupancy, etc.) will be charged at 100%.

MSC CRUISES CONDITIONS
The cancellation fees are 100% from the booking confirmation. Any change to the contract (passenger substitution, cabin occupancy, etc.) will be invoiced at 100%.
Condition of cancellation MSC YACHT CLUB (excluding world tour)
- Up to 120 days before departure: 200€ per person
- Between 119 and 90 days before departure: 35% of the cruise price
- Between 89 and 60 days before departure: 50% of the cruise price
- Between 59 and 30 days before departure: 80% of the cruise price
- Between 29 and 15 days before departure: 100% of the cruise price
- Less than 30 days before departure: 100% of the cruise price
Payment of the trip 90 days before departure
A tariff adjustment may be applied to the dossier in case of partial cancellation.

SPECIAL CONDITIONS GROUP CANCELLATION
- more than 150 days from the departure date: 20% of the total cost of the trip
- from 149 to 90 days from the departure date: 30% of the total cost of the trip
- from 89 to 60 days before the departure date: 60% of the total cost of the trip
- less than 60 days from the date of departure: 100% of the total cost of the trip

SPECIAL CONDITIONS FOR CANCELLATION OF "WORLD TOUR" CRUISES (CRUISES of 42 nights and more) and GRAND CRUISE OF AFRICA
- more than 120 days before the departure date: 25% of the total cost of the trip
- from 120 to 91 days before the date of departure: 50 % of the total cost of the trip
- from 90 to 61 days prior to departure: 75 % of the total cost of the trip
- from 60 days from the date of departure or failure to board: 100 % of the total cost of the trip
In case of refund the waiting time is 90 days. 

SPECIAL CONDITIONS SUPPLIERS HAMILTON AND ORANGE FOR CRUISES 
All bookings made through the above-mentioned suppliers and for all cruises identified with PSM in the description in the purchase contract will be subject to 100% penalty from the time of booking. 

 

4) Sending of travel documents

Cruisetopic trusts in the accuracy of the information provided by the client. Cruisetopic cannot therefore be held responsible to the client for the loss of paper documents caused by an incorrect address nor for the non-delivery of e-tickets due to the inaccuracy of the e-mail address, the incorrect installation of the e-mail program, the action of spam filters or inefficiencies of the Internet network. It is the customer's duty to promptly communicate any change of e-mail address or telephone number. Customers are also requested to verify that the name on their passport or identity card matches the name on their ticket. It is the client's responsibility to notify Cruisetopic promptly of any incorrectness of all passenger data. In the event that the non-delivery of customer documents is not reported well in advance, and in any case not earlier than seven days before the date of departure, Cruisetopic can not in any way guarantee the timely delivery of replacement tickets.

 5) Authorization for the use of data

Your data may be used to provide you with the highest possible level of service and to contact you in the event of changes to your travel plans, such as changes in flight times, delays, etc. In addition, we may use your information to provide you with updates about our products and services, our special offers and promotions, and to send you informational materials that may be of interest to you. Commercial communications may be sent by email, fax, Mms or Sms only with your consent. Although such communications may include, from time to time, information about third party products, such third parties will NOT contact you directly (unless expressly invited to do so).

Cruisetopic undertakes not to disclose the data of its users to third parties, except in cases where it is necessary to do so in order to complete a booking, purchase or any other request made via the website, or in cases provided for in this policy. We are also obliged to disclose your personal data in all cases provided for by law, and these data may also be disclosed to third parties and professional consultants who act on our behalf and who are obliged to maintain confidentiality.

User data may be shared with Shipping Companies or Tour Operators and Travel Agencies when the user makes a booking request in order to make the booking possible and to provide our products or services requested by the user. Depending on the request, this information may include your name, contact information, passport information, booking or travel itinerary details, your preferences, any special requests or accommodations, information or comments you choose to provide (if any), and other information requested by specific Cruise Lines or Tour Operators and Travel Agents.

User information may be shared with companies in our group. We share user information with our affiliates and subsidiaries. We may share your information with our group companies for the following reasons: (i)to provide you with integrated services (including administering and managing reservations, services and payments on all of our affiliated platforms); (ii)to provide you with personalized offers or send you marketing communications with your consent or as permitted by applicable law; (iii)analyze how users use our affiliated and independent platforms so that we can, for example, improve existing products and services and develop new products, services and features that may be relevant to our users;(iv) ensure compliance with applicable laws; (v) provide customer support services; and (vi) detect, prevent and investigate fraud and misuse of our services and products, other illegal activities and data breaches.

In addition, we share your information to make payments. In order to use certain services and products (e.g., to book a cruise) and to make payments to Cruise Lines or Tour Operators and Travel Agents, we need payment information (e.g., credit or debit card information, information about other online payment methods, etc.). When you submit your payment information through our Services, we share that information with Navigation Company or Tour Operators and Travel Agents, third party payment processors and other third party service providers (including, but not limited to, companies that provide fraud detection services to us and other third parties), to the extent necessary to fulfill our contractual obligations to you (e.g., to secure a reservation or make a payment). to secure a reservation or make a payment where necessary), to satisfy our legitimate interests in preventing fraud and other misuse of our platforms or services, or with your consent where required by law. In particular: (i) when you use a credit or debit card to secure a reservation through our Services, we provide your credit or debit card information (including card number and expiration date and, if required by the Travel Companies or Tour Operators and Travel Agencies, CVV number) to the relevant Travel Agency or Travel Company to process the transaction. (ii) When you provide your credit or debit card information through our Services, you have the option to save such information in your account for future use. If you choose not to save your credit or debit card information in your account, we delete such information once the transaction is completed.

Cruisetopic also uses "cookies" to collect information about how users use the website. Cookies are text files that are used for statistical purposes without any intent to harm or violate privacy and that allow us to temporarily store information on your PC: this allows us to recognize the computer used to access the website www.Cruisetopic.it. Any information contained in the Cookies will not be used for any other purpose than that stated above. Most PCs automatically accept cookies: You can still delete cookies that already exist on your PC. You can also change your options so that you do not receive cookies in the future.

6) Regulations of the online contract

The specific articles of law, relating to the sale "on line", extracted from the "Tourism Code".
Legislative Decree of May 23, 2011 n. 79 ART. 32 (Scope) and Art. 3 (Subjects and scope) Art. 4 (Definitions) of Law n. 93/2015 (Tourism Code).
Companies conducting business activities in the field of tourism, on a contractual basis, outside the territory of the Republic of Albania, must act in accordance with the provisions of Albanian legislation, provided that they do not contravene the laws of the foreign state where these activities are carried out.
The provisions of this Chapter shall apply to tourist packages as defined in Article 34 and Article 4.21, sold or offered for sale to anyone by the organizer or intermediary, as defined in Article 33. 2 and Article 4. 1 (Tourism Code). This chapter also applies to tourist packages negotiated outside commercial premises or at a distance. This is without prejudice to the provisions laid down in articles 64 to 67 of Legislative Decree 206 of 6 September 2005 and in articles 36 to 37/6 of Law 9902/2008 (Consumer Code). In this case the professional is obliged to communicate in writing the exclusion of the right of withdrawal. Failure to communicate the non-existence of the right of withdrawal determines the applicability of Articles 64, 65, 66 and 67 of Legislative Decree September 6, 2005, No 206 and Articles 36 and 37/1, 37/3, 37/4, 37/5 and 37/6 of Law 9902/2008.
For matters not covered by this chapter, the provisions of Legislative Decree 6 September 2005, No 206 and Law 9902/2008 (Consumer Code) shall apply. The online sale of tourist services on line is part of the c.d. "Telematic Reservation", the proposals on the site are defined as electronic catalog. Confirmation takes place with a click (c.d. point and click contract). It is necessary to provide for the cancellation of booking and the possible penalty (art. 1382 of the Civil Code "penalty clause" and art. 541 of the Civil Code). Distance contracts are, moreover, defined by the Consumer Code article 50 letter a and article 37), the discipline of article 52 and article 36, of the same code, regarding the obligation to inform the client, must be applied. Therefore, these are contracts with computer execution, which provide for an integration of the rules of the consumer code with the rules of electronic commerce (article 68 consumer code that refers to the legislative decree April 9, 2003, n. 70 - Implementation of Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the internal market and article 37.9 of the law n.9902/2008.
The right of withdrawal is exercised pursuant to and for the purposes of art. 64 et seq. of Legislative Decree 206/05 and art. 36 et seq. of Law n.9902/2008 (Consumer Code). Beyond its generic and well-established civil nature, the Consumer Code has recognized the consumer, for contracts concluded at a distance and off-premises, the right to withdraw unilaterally from the contract entered into for the purchase of goods and services. However, the right of withdrawal can not be exercised by the consumer, inter alia, services relating to accommodation, transport, catering, leisure, when and 'provided for a date or a specified period for the supply (eg by reservation), provided that such provisions are written on the contract and, therefore, the consumer is aware of it. A fortiori there is no right of withdrawal by the consumer, according to the coordinated provisions of Article 55 paragraph 1, letter b) and Article 37/8/h of Law No. 9902/2008 of the Consumer Code (contracts last minute and last second - as it falls within the limit of 10 days).

Limitation of liability for the use of the site
Cruisetopic (together with its officers, directors, employees, representatives, affiliates, and related third parties), to the extent permitted by law, hereby expressly disclaims liability with respect to: (a) any loss or damage to, or viruses that may infect, your computer, computer program, data, or other property as a result of accessing the Internet site, downloading any content from the site ; or (b) any damage, death, loss, claim, act of God, delay, or any extraordinary occurrence, penalty, compensation, direct or indirect, incidental or consequential damages for any cause whatsoever (including lost profits or lost revenue), whether based on contract or tort (including negligence), direct liability or any other form, which may arise out of, or be in any way connected with: (i) any use of the site or its content; (ii) any failure or delay (including the use of, or inability to use, any part of the site for reservations); or (iii) the result or failure of Cruisetopic or any Cruise Company or Tour Operator and Travel Agency, even if aware of the possibility of damage to such parties or others.

CHANGES TO THIS POLICY
Except to the extent restricted by applicable law, we will periodically update this Privacy Policy to reflect changes in our privacy practices, legal requirements and other factors by posting a prominent notice of the update on our Services. Changes to our Privacy Policy will become effective once posted and the new effective date is indicated.
If we make any changes to the Privacy Policy that significantly affect personal information previously collected about you, we will make reasonable efforts to provide notice of and obtain consent to such changes as required by law.
